Terms and Conditions
Most of the work we undertake is complex and requires an inspection by our surveyor before we accept it. If we decide to survey your work this will be done solely at our expense, but we will not be committed to carrying out your work until our surveyor has confirmed to us that the work is within our capability.
Cancellation
By us: Following consideration of our surveyor’s report, we reserve the right not to proceed with the work you wish carried out. If we decide not to proceed we will return any deposit paid at once, without interest, and we will have no further liability to you, nor you to us.
By you: If you decide to cancel your work once we have accepted our surveyor’s report, and we have started to manufacture your order, you must pay us the entire quoted cost of the work, as the work will be to your particular specification and will not be of use to others. If the work does not require goods to be manufactured, or we have not started to manufacture your order, you may cancel your order and we will return your deposit at once, less a handling charge of 30% of the value of your deposit.
Installation
You will permit our staff to work without interruption, during working hours, to enable us to complete our work efficiently.
We will not be liable for any consequences of any delays that may occur. Any estimate we give you of the time that will be taken to complete your work is given in good faith. If the estimate is wrong and we take more time to complete than expected we will not compensate you.
If you delay commencement of your work beyond twelve weeks from the date we accepted your order, the order may be subject to a price increase. The price will be directly related to any increase that we have to pay for labour and materials and this increase must be paid by you and will not entitle you to cancel your order.
You are responsible for the removal of all curtains, blinds and any other adornments or decorations close to the windows or doors to be worked and which might be harmed by dust, dirt or debris from the installation work, before our staff arrive to commence work. We reserve the right to charge you at our current daily rates if we have to move valuables or other objects on your behalf. Any of your property moved by our workmen will be moved at your risk alone. We will not be held responsible for any damage caused, or alleged to be caused, to such property by our workmen.
The glass we use is the best available but we cannot guarantee perfection.
We do not guarantee that double-glazing will reduce condensation on your window panes.
Our site staff are not permitted to undertake work which may involve you in expense that is additional to the work stated in this agreement. However, if when having stripped down the window or door, they find problems that require addressing before the work can be completed, they will obtain permission to carry out this work from you the customer or from our head office. An extra and over cost will be agreed by both parties when the work is completed.
Guarantee
New products carry a 5-year guarantee on all timber and sealed glass units. We will honour any warranties given by our suppliers. Installation work carries a 12 months guarantee against failure due to poor workmanship, but does not extend to fair wear and tear or damage caused by accident, including storm damage, misuse or neglect. Defective brickwork will invalidate the guarantee.
Our guarantee is not transferable, and is void if the full price agreed for the work is not paid.
Damage to your property caused by us
We will make good any damage that we cause to sound plaster, flooring, covering, render or brickwork which immediately surrounds any window or door on which we work. However, you accept that we do not guarantee not to cause superficial damage to wallpaper, paintwork or ceramic tiles surrounding the area on which we are working. You are responsible for the cost of repair to such damage.
We will not accept any responsibility for any damage that results from any structural or other defect in the building.
Removing frames and sashes inevitably causes small areas of paintwork to be chipped. We will cover these chips with one coat of white paint, which we will supply, or one coat of any other colour paint supplied by you at the time of installation. We will not undertake any further redecoration of your windows or doors.
You must accept that minor surface marks or blemishes and other imperfections are inevitably caused to timber products during the manufacture and installation of windows and doors.
We do not guarantee not to damage or break any panes of glass or frames from old windows and doors that you may wish to retain.
Our installation fitters are authorised to accept payment of the balance of your account, which is due on practical completion of the work. Any minor works or adjustments that you may consider require attention following installation are not a valid reason for withholding payment. You may pay by cheque or cash. Cheques must be made payable to the Company. We reserve the right to charge interest on any overdue balance at 2½% per month, pro rata.
If there is any defect in our work, you may retain 5% of the outstanding balance until the defect has been rectified. Payment of the balance is due immediately following rectification of the defect.
We recommend that in order to maximise the life of your windows and to maintain our guarantee your paintwork should be washed regularly. Waxed wood should be waxed at monthly intervals for the first 3 months and regularly thereafter. We acknowledge that your rights to cancel under the Consumer Credit Act 1974 are in no way affected by these terms and conditions.
